This Privacy Policy, which is a part of our Terms of Use, explains how LearnOnAir (“we”, “our”, or “us”) collects, stores, uses and shares personally identifiable information of students and instructors on its website. By creating an account with LearnOnAir, you voluntarily and willingly provide us with certain information, referred to as “personally identifiable information”, which we collect to provide you with our services. Personally identifiable information is information that can be used to identify you as a user, including but not limited to, your name and email address, ABN Number, PayPal account information and location. There are two types of personally identifiable information we store on our website, the first is the information you must provide us when creating an account or enrolling into a lesson. The second is the information and exchanges you choose to make on our website and through its features (in-class messaging), including but not limited to, communications you make with your instructors and other students. The generic term “information” in this Privacy Policy addresses both types and uses of information. By using our website, creating an account, by participating in our live lessons, by accessing content and materials you consent to the collection, use and disclosure of your personally identifiable information in accordance with the terms detailed below. If you are not comfortable with LearnOnAir collecting, storing, using and sharing your information, then you should not sign up to become a member and, if you are already a member, you should terminate your account immediately.
What information we collect
It is possible to browse our website as a site visitor without having to disclose any personally identifiable information about yourself. However, if you request to receive information about our lessons or services in general or provide a comment or a feedback about our website or services, you will be prompted to provide us with contact information so that we can get back to you on your request. If you leave us your email address, we may also send you additional information about our lessons or services that you may be interested in.
Personally Identifiable Information
To participate in a lesson as a student or teach a lesson as an instructor, you will have to register as a user and create a user account. This will require that you provide certain personally identifiable information that includes, but not limited to, your name, e-mail address, contact number and a password. When you provide us with these information, you allow us to use it in order to register you to access and use all parts of our website, to enrol in lessons, to verify your authority when you enter the website and access lessons, notify you of updates, improve the site content and notify you of upcoming lessons and other services that you have purchased or may be interested in. As part of this Privacy Policy, you also consent to us providing your personally identifiable information to your instructors as part of the lessons information when you enrol in a lesson or send a request to an instructor. Although we do not control how instructors use the information we provide them, we can say that instructors will use this information to teach you the lesson and to make sure that it is you who are taking the lesson. Instructors can share more information than students, including but not limited to, their education, professional experience, academic publications, awards, and interests.
Publicly viewable Personally Identifiable Information
As an instructor, when you create or update your account or otherwise interact with LearnOnAir, we collect and store the data you provide. Some of these data will be publicly viewable data collected by LearnOnAir like your first name, last name, summary info about yourself, your occupation, language, country, state, city, your Working with children check or teachers registration card, social media accounts, location, profile information, cv, interested categories, website URL, your Facebook, Twitter, Google+, Pinterest and Instagram, your weekly day schedule, promotional video clip, photo or avatar.
As a student, your shared content and profile data may also be publicly viewable to other students and instructors depending on your profile and account settings. If you ask a question to an instructor, your information, including your name, may also be publicly viewable by other users. If you rate and review an instructor, you may leave a review that reflects your experience with the session and the instructor, and the score you give and the comment you make may also be publicly viewable by others. (The purpose of the rate and review system in LearnOnAir is to improve the reliability and quality of online education. While the LearnOnAir rate and review system is intended to function as an open forum for students and instructors, our guidelines and policies listed here and in “Terms of Use” are applicable to ensure fair and proper use.)
Publicly viewable official documents
At LearnOnAir, instructors are required to upload their valid Working with Children Check card or an equivalent card such as Teachers Registration Card to give online lessons to those under the age of 18. Instructors can also upload their diplomas and certificates to prove their level and proficiency on the subjects they are willing to teach. LearnOnAir users will be able to see and check the validity of all the official documents uploaded to LearnOnAir.
Publicly non-viewable Personally Identifiable Information
We don’t share your phone number, email address, recording of the lessons you give or participated in, your PayPal account information and your ABN unless LearnOnAir undergoes a business transaction like a merger, acquisition, corporate divestiture, or dissolution or bankruptcy, or a sale of all or some of its assets. We may share, disclose, or transfer all of your data to the successor organisation during such transition or when in contemplation of a transition.
Student Payment Information
If you make purchases as a student, we collect certain data about your purchase such as your name, PayPal account information and location as it is necessary to process your order. You must provide certain payment and billing data directly to our payment processing partners, including your name, credit card information, and billing address. For security reasons, LearnOnAir does not collect or store sensitive cardholder data, such as full credit card numbers or card authentication data.
Instructor Payment Information
If you are an instructor, you need to link your PayPal account to receive payments. When an account is linked, we collect and use certain information, including your payment account email address, account ID or other data necessary for us to send payments to your account. For security reasons, LearnOnAir does not collect or store sensitive bank account information. The collection, use, and disclosure of your payment and billing data is subject to the privacy policy and terms of your payment account provider.
Non-personal Information
LearnOnAir may also automatically collect and analyze information about your general use of our site, lessons, content and materials. We may keep track of your usage patterns to see what pages of our site were visited, in what order they were visited, when they were visited, which hyperlinks were clicked, the type of browser, language, IP address and operating system you are using, and cookies and data about how you use our website and services in general and we store this information in log files. The information that we collect and analyze does not personally identify you. We use this data to help us further in operating our website and share the data with other third parties to enable them to better understand the operation of our website and lessons. Generally, you will not have to interact with any third parties, but we tell you if there is the need to do so and we will receive your consent before you interact with third-party services which may be available through our website, including but not limited to, surveys and questionnaires.
We may also use the information that we collect from you when you participate in live lessons for administration purposes, including but not limited to, tracking your attendance, progress and completion of your lesson. We may also share your information and performance in one of the lessons with the instructor/s who taught the lesson or with others designated by the instructor/s to help create, change or make better the lessons.
Disclosure of Information
Disclosure of Information for Analytics and Data Enrichment Services
As part of our use of third-party analytics tools like Google Analytics we share certain contact information, account data, system data, usage data, or de-identified data as needed. De-identified data is data where your name and email address have been removed and replaced with a token ID. This allows these providers to provide analytics services or match your data with publicly-available database information (including contact and social information from other sources). We do this to communicate with you in a more effective and customized manner.
Disclosure of Information for Advertising
If we decide to offer advertising in the future, we may use and share certain system data and usage data with third-party advertisers and networks to show general demographic and preference information among our users. We may also allow advertisers to collect system data through data collection tools and to use this data to offer targeted ad delivery to personalize user experience and undertake web analytics.
Disclosure of Recordings
By signing up for LearnOnAir services and attending LearnOnAir sessions, you expressly acknowledge that your instructor, who owns and hosts the session, may make and store recordings of the session you have attended for quality and review purposes. You will be able to see the recording notification on the screen if your instructor is making a recording. At any point you may ask your instructor to stop the recording. If an instructor does not stop recording after your request you can leave the session in the first 15 minutes and get a full refund.
Although instructors own the session and the recordings of the sessions, they cannot sell, share or broadcast these recordings without the consents of all participants.
LearnOnAir does not record sessions for its own use.
Disclosure of information to Third parties
We will share your personally identifiable information with third parties only as described in this privacy policy. We share your data with third-party companies who perform services on our behalf, like Zoom for online meeting services, PayPal for payment processing, and Vimeo for media related services. These service providers may access your personal data and are required to use it solely as we direct them, that is, to provide our services as requested.
Your interactions with these third party services are governed by the third-party company’s privacy policy and terms and conditions. Please refer to their terms and conditions and privacy policies for more information. LearnOnAir will NOT sell your personal information to third parties.
Disclosure of information for Legal Compliance
LearnOnAir also has a legal responsibility to disclose personal information to exercise its legal rights, defend against legal claims or to protect its interests. We may also disclose data to third parties if we believe in good faith that the disclosure is permitted or required by law, requested as part of a judicial, governmental, or legal inquiry, order, or proceeding, reasonably necessary as part of a valid subpoena, warrant, or other legally-valid request, reasonably necessary to enforce our Terms of Use, Privacy Policy, and other legal agreements, required to detect, prevent, or address fraud, abuse, misuse, potential violations of law (or rule or regulation), or security or technical issues or reasonably necessary in our discretion to protect against imminent harm to the rights, property, or safety of LearnOnAir, our users, employees, members of the public, or our Services. We may also disclose data about you to our auditors and legal advisors in order to assess our disclosure obligations and rights under this Privacy Policy.
Referrals
If you choose to use our referral service to tell a friend about LearnOnAir, you acknowledge that you have their consent when providing us with their name and email address. LearnOnAir will automatically send your friend a one-time email inviting him or her to visit the website. Unless we are authorized by your friend, we will only use your friend’s name and email address for the purposes of sending this one-time email and maintaining an activity log of our referral program.
What you can choose and control
From time to time, you may receive emails about a new lesson or an update about a feature or a service that we believe may be of interest to you. If you wish to opt-out of receiving this information, you can unsubscribe by clicking the “unsubscribe” link at the bottom of the emails, or manage your account settings in your profile. LearnOnAir gives you the control and the choice to edit or remove, change and correct certain information on our site, even those that you no longer wish to be publicly visible on our site.
Contacting you
Occasionally, LearnOnAir may contact you and ask you to give us some information about your experience as a user, which we may use to improve our website and services. This is something voluntary and it is not obligatory for you to provide us with such information. We will mainly use email and messages sent to your user account to notify you of anything new.
Security and Confidentiality
LearnOnAir takes the security and confidentiality of its users very seriously. When you register as a student or instructor you take on the responsibility of maintaining the security of your account. Your user account is protected by a password. It is your duty as a user to protect yourself from unauthorized people accessing your account and information by choosing your password carefully, with a myriad of lower and uppercase letters, numbers and symbols, and keeping your password and computer secure by signing out after each use.
LearnOnAir uses software and technology to protect your personally identifiable information unauthorized access, disclosure, changes or loss. We may use software, secure socket layer technology (SSL) encryption, password protection, firewalls, internal restrictions and other security measures to help prevent unauthorized access. Unfortunately, nothing is 100% secure over the internet so even though we will do our best to protect your information, we cannot guarantee absolute security that unauthorized people will never be able to overcome the technologies we put in place. Therefore, you must keep in mind that when you voluntarily share your personally identifiable information publicly, that information could be taken and used by others, and we are not responsible if you choose to do so.
Data Retention
We at LearnOnAir retain information on our website and personal data of our users for as long as necessary and for as long as your account is active. If you do not want us to use your information to provide you with services, you may close your account now. We will use personal information for reasons including, but not limited to, complying with our legal obligations, resolving disputes, and enforcing our agreements with users in case there is a breach of the terms.
Updating our policy
We at LearnOnAir hold the right to change and update this Privacy Policy from time to time. Any amendments made will be effective immediately upon posting on our site. We will post the revised Privacy Policy on our site located at www.learnonair.com/privacy/ and will send you an e-mail and a notification on your account to see once you log in. We encourage you to review this Privacy Policy periodically to keep yourself updated for any changes. Your continued use of LearnOnAir website and services following changes to our terms constitute acceptance of our amended terms.
Children
We at LearnOnAir take the privacy interests of children very seriously and we encourage parents and guardians to do the same. We recommend that parents and guardians take an active role in children’s online activities. We do not collect the personal information from children under the age of 18 intentionally. If we learn that we have unintentionally collected personal information from a child under 18, we will delete such information. As previously mentioned in our terms of use, children under the age of 18 may not register for an account by themselves, they may only do so under the supervision and approval of a parent or legal guardian. If you are under the age of 18, then please do not use this site by yourself.
